1. Acceptance of Terms
By accessing and using TrackTag ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
TrackTag provides AI-powered music analysis for producers, labels and creators: track naming, tagging, metadata extraction and description generation. The Service is delivered through the TrackTag Lab (single-track tools, on free and paid subscription tiers), TrackTag Studio (batch analysis paid with one-time credit packs, or a flat-rate Unlimited-BYOK plan), the TrackTag desktop app for Mac and Windows, and programmatic access through our public API, our MCP server and our Zapier integration.
Studio analysis is offered at two levels, Core and Ultra. Both run the same analysis engine on the same audio; the level determines how many metadata fields are returned and therefore how many credits a track costs. Field counts, prices and any credit cost are always displayed before you start a run.
3. User Accounts
Registration

Account Responsibilities
- •You are responsible for all activities under your account
- •You must notify us immediately of any unauthorized use
- •We reserve the right to suspend or terminate accounts that violate these terms
4. Subscription and Payments
Free Plan
- •Limited AI analysis credits per month
- •Access to manual track tagging features
- •No saved sessions or analytics
Lab Pro Plan
- •Monthly subscription at $5.99/month
- •100 AI analysis credits per month
- •Unlimited saved sessions and analytics
- •Export functionality
Billing
- •Subscriptions are billed monthly or yearly in advance
- •Payment processing is handled securely by Stripe
- •You can cancel your subscription at any time
- •Cancellations take effect at the end of the current billing period
5. Credits, One-Time Purchases & Refund Policy
All credit purchases are final
Credit packs are one-time purchases and are non-refundable. We do not refund credits, in full or in part, for any reason, except where a refund is required by applicable law.
Credit Packs (TrackTag Studio)
- •Studio credit packs (Starter, Studio, Producer, Professional) are one-time purchases, not subscriptions: there is no recurring charge and nothing to cancel
- •All credit pack sales are final and non-refundable once the purchase is completed
- •Credits have no cash or monetary value, cannot be exchanged or redeemed for money, and are non-transferable between accounts
- •Credits do not expire while your account remains in good standing
- •Credit cost depends on the analysis level you choose: Core costs 1 credit per track and Ultra costs 2, regardless of the length or format of the file. The cost of a run is always shown before you start it
- •Re-analyzing a track that was analyzed on Core at the Ultra level costs only the 1-credit difference, provided the original 1-credit charge is on record for your account and the track has not already been upgraded. Otherwise the re-analysis is charged at the normal Ultra price
- •If an individual track fails to analyze, the credits for that track are automatically returned to your credit balance, always as credits, never as money
- •Cancelling a running batch returns the credits for unprocessed tracks to your credit balance
- •Unused credits are not refundable if you stop using the Service, and are forfeited if your account is terminated for violating these Terms
Subscriptions (TrackTag Lab Pro & Studio BYOK)
- •Subscriptions are billed in advance and can be cancelled at any time; cancellation takes effect at the end of the current billing period
- •We do not provide refunds or credits for partial billing periods, unused time, or unused monthly allowances
- •The Studio BYOK plan is a platform-access fee only: analyses run on your own Google Gemini API key and Google bills you directly for all API usage. We have no control over, no responsibility for, and provide no refunds of any charges billed by Google or any other third-party provider
Stored Data & Retention
- •Studio analysis history is stored on your account and does not expire. It is not tied to a subscription, and we do not delete it when your credit balance reaches zero or you stop using the Service
- •Analysis history is removed when you delete a batch yourself, or when your account is closed. Closing an account permanently erases all stored analysis results, so export anything you want to keep first
- •We may remove stored data if your account is terminated for violating these Terms. If we ever introduce a retention limit, we will give existing users notice by email before it applies to their data
Chargebacks & Pricing
- •Initiating a payment dispute or chargeback on a legitimate charge may result in immediate suspension of your account and forfeiture of remaining credits. Please contact support first; we respond quickly
- •We may change pack sizes and prices at any time; price changes never affect credits you have already purchased
- •Purchases are processed by Stripe; by purchasing you also agree to Stripe's terms
6. Acceptable Use
You agree NOT to:
- •Use the Service for any illegal purposes
- •Upload content that infringes on others' intellectual property
- •Attempt to reverse engineer or hack the Service
- •Automate access to the Service by any means other than our official API, MCP server or Zapier integration, using a valid API key and staying within its published rate limits
- •Share your account credentials with others
- •Abuse or spam our AI services
- •Share, resell or publish an API key issued to your account, or use one to provide analysis to third parties as if it were your own service
- •Post abusive, misleading or infringing content to public areas of the Service such as the feature request board. We may remove such content and it may be visible to other users until we do
7. Intellectual Property
Your Content
- •You retain all rights to the music and content you upload
- •You grant us a license to process your content to provide the Service
- •We do not claim ownership of your music or creative work
Our Service
- •The Service, including all software, design, and AI models, is owned by TrackTag
- •You may not copy, modify, or distribute any part of the Service
8. AI-Generated Content
AI Analysis
- •AI-generated track names, tags, and descriptions are provided as suggestions
- •We do not guarantee the accuracy or suitability of AI-generated content
- •You are responsible for reviewing and approving all AI suggestions
Usage Rights
- •You may use AI-generated suggestions in your commercial projects
- •We do not claim rights to content created using our AI suggestions
9. Service Availability
- •We strive to maintain 99% uptime but cannot guarantee uninterrupted service
- •We reserve the right to modify or discontinue features with notice
- •Scheduled maintenance will be communicated in advance
- •Live and historical availability for the website, the analysis engine, the API and sign-in is published at status.tracktag.me, monitored independently of the Service
- •An outage does not cost you credits: credits are charged per completed analysis, and any analysis that fails or is cancelled returns its credits to your balance automatically
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- •The Service is provided "AS IS" without warranties
- •We are not liable for any indirect, incidental, or consequential damages
- •Our total liability shall not exceed the amount you paid in the last 12 months
11. Termination
We may terminate or suspend your account if you:
- •Violate these Terms of Service
- •Engage in fraudulent activity
- •Abuse the Service or our support team
You may terminate your account at any time through your profile settings.
12. Audio File Processing and Privacy
🔒 Your Audio Files Are Private
We do not collect, store, or keep any of your audio files.
How We Process Your Audio
- •Audio is transmitted only when you start an analysis. It passes through our service in memory and is forwarded to third-party AI providers (currently Google Gemini) that listen to it and return metadata
- •Files are held only for the seconds the analysis takes and are discarded immediately afterwards. We never write your audio to disk, to a database or to any file storage
- •Connecting folders in My Library, in the browser or in the desktop app, does not upload anything. Those scans read file names and sizes locally on your own computer
- •On the Unlimited-BYOK plan, audio goes to Google under your own API key and Google's terms apply to that traffic
- •Your audio files are never used for training AI models or data collection purposes
What We Store
- •We only store the AI-generated metadata (track names, tags, and descriptions)
- •Your session data and preferences are stored to improve your experience
- •No audio content, waveforms, or derivative audio data is retained
Your use of the Service is also governed by our Privacy Policy. We collect and process data as described in that policy.
13. Changes to Terms
We may update these Terms of Service from time to time. We will notify you of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the new terms.
14. Governing Law
These terms are governed by the laws of the jurisdiction where TrackTag operates. Any disputes shall be resolved in the appropriate courts of that jurisdiction.
